The new website, Moscowid.net, which hosts primary source documents related to Doug Wilson, Christ Church, and the ongoing sex abuse cases, has run into legal issues.  No surprises here. This is a common tactic used by those who want to shut bloggers down for exposing pastors who do not behave well. There is a concerted effort to shut down, malign, or ruin the reputation of anyone who challenges these spiritual bullies.

A word to the wise to Doug Wilson et al:  we know we’re on the right track when we get legal threats, when our blogs are mysteriously knocked offline (The Wartburg Watch has had “tech” issues for the last 2 days).  It only compels us to keep going.  

Another word to the wise:  I won my defamation lawsuit and my former pastor had to pay his attorney fees, my attorney fees, and court costs.  I know that my words are not defamatory because I understand this law.  Don’t try it with me. 

I have been given permission to cross-post the article from Moscowid.net explaining what has happened there. It’s very important that the public understand what is going on behind the scenes in an effort to shut bloggers down.

“Unmarketable Positions”

Moscowid.net may go dark for a few days, but not for long. We have received legal notice that Daniel Foucachon, who owns Foucachon Media, LLC, and Roman Roads Media, LLC, claims copyright ownership of screenshots from videos that he placed in the public domain; he claims copyright ownership of a video on which he enabled a “download” button after he uploaded it to the web; he claims that moscowid.net profits from these things; he claims defamation, though he has not identified any defamatory content; and he makes these claims “under the perjury laws of the United States of America.” This complaint, like all his others, has no merit, but that doesn’t matter. As long as he submits the complaint according to federal guidelines, Team Truth must remove the content or the host must shut us down. And Daniel Foucachon submitted his correctly.

The legal department wrote,

Unfortunately, we are not able to make determinations as to the validity of a DMCA notice. If the notice is properly submitted, we are required by US Federal law to take action. The notice was properly submitted.

Daniel Foucachon games the system just like Steven Sitler games the system. Foucachon knows a simple complaint with the correct language will shut us down, even though he must lie to achieve his goal. Ditto for Sitler. The state wires him to the polygraph and as long as his answers don’t self-incriminate, he knows the law cannot touch him. “Have you molested your son?” “No.” Needle shreds paper.

How appropriate that they attend the same church.

This is page 1 of Pastor Doug Wilson’s playbook. Stop the message at all costs. He loves publicity as long as he controls the message. Then he can congratulate himself, as he did with Christianity Today:

I decided that if fire fell on Moscow, as upon Elijah’s altar, I wanted it to fall on an altar doused with water. I made a point of adopting certain unmarketable positions. I’m a televangelist with a blacked-out tooth — so if something happens, it’s God’s work.

Pastor Douglas Wilson of Christ Church, Moscow, doesn’t point to the altar where he officiated the marriage of a serial pedophile to a profoundly naïve student from New Saint Andrews College. He points to an imaginary altar that doesn’t exist. And he stomps when we point to the real altar where he performed the abomination.

Therefore, in order to comply with US law, we have removed our images that we own according to the FAIR USE Act. But not for long.

    The federal appellate court, the Ninth Circuit Court of Appeals, published an opinion on September 14, 2015, in a case of a take down notice and “Fair Use”. The blogger won. The importance of this decision is that it is binding on all of the federal trial courts within the Ninth Circuit Court of Appeals’ legal jurisdiction, which includes Idaho. (Copyright law is covered under federal law, not state law.)

Since this entire discussion, including the blog in Idaho, is about child sexual abuse I wanted to share this 2-hour workshop on child sexual abuse in the church and its prevention done by Pastor Jimmy Hinton. (Jimmy turned in his pastor/father for sexually abusing children at the church they have both pastored. Their church is in the Church of Christ denomination and was started about 100 years ago in PA. Jimmy’s father is now serving a life sentence in prison for sexually abusing some 23 known victims. He and his mother Clara Hinton, the Finding a Healing Place blog, have become advocates for victims. I have also posted the video at the top of the page here on the Off Topic Discussion tab.)

  5. Michael, I thought about the same exact thing enough to check the registered sex offender list for Doug Wilson.

    I do know that mega church pastor from Richmond, Virginia Geronimo Aguilar (who was a very vocal defender of Jack Schaap when he was arrested / convicted for sex with a 16 year old girl after transporting her across state lines committing MANN Act violation / Federal crime) was himself convicted in July. Aguilar who annually for 15 years attended Schaaps pastor’s conference was convicted of aggravated sex of a minor, 3 counts of sex with girls under the age of 17 ( started when they were 11 & 13). He faces multiple life sentences and will probably never be a free man again.

    Another baptist preacher was arrested after being contacted by a undercover sheriff deputies who responded to his Craig’slist ad seeking a dog whose owner would allow him to have sex with it. The deputies claimed to have a dog and interest in the same type of perversion. The pastor showed up ready to pay for sex with the dog and was arrested.

    That’s just three Pastor Pervert cases and there are many others. As my best bud, Brenda say, ” Patriarchy is a hiding place for demented PERVs and very weak men that hide behind titles and perceived authority” . She also calls them a bunch of limp ________ bastards, but I don’t want to embarrass her if she reads this as she can probably beat me up. I love kidding her about her days as a Bill GothardITE by asking if Bill liked her feet.

  6. I concur Michael and Scott: Birds of a feather flock together. All of these big name proponents in patriarchy are being felled by sexual abuse scandals. Why are the churches shoving these doctrines of men, and more importantly the doctrines of boundary-less sex offenders, on Christians? Do we look to other messed up, shady criminals for *guidance* in how to lead our lives????

  7. There is no depth of evil that this man won’t find himself. Or those that associate with him, enable him, or commit sins in the vacuum of his tolerance for such horrific crimes.

    He has sided with pedophiles (note the plural).

    No other evil deed in addition to this should come as a surprise.

    If the only thing I had to understand Christianity were these critters that falsely take on the moniker “Christian”, I would stay away from it like the plague because of these egocentric jerks. I would warn people against the evil of Christianity with its abuse of children, disrespect of women and the worshiping of the penis (or is it the Y chromosome?)

    Thank God I know Jesus and make the distinction between Him and the bags of rotting feces that profit by peddling a nightmare existence they consider a model of Christianity.

    Whatever price these bags ‘o’ feces pay for their deeds is insufficient. (apologies to actual pieces of feces for being compared to these jerks.)

  9. Anyone who has information about criminal activity or accessory to criminal activity by Doug Wilson should contact the DOJ and the FBI.

    This should be our message and we should spread it as far as we can. The time is now for victims to come forward.

    I hope you will report Daniel’s *take down* notice that you received to the Electronic Frontier Foundation at the website I posted above and Chilling Effects.

    Daniel can be sued for infringing on the legal rights of others for Fair Use and their First Amendment rights. People are permitted to blog and comment about pedophile Sitler’s wedding to Katie. It can be used for *news*.

    Definition of scare tactic from the Encyclopedia of patriarchal nonsense: any action by a patriarch whether violent or not that is design to cause fear and thus manipulate the recipient into capitulation (this is not to be confused with copulation which some patriarchs also seek to manipulate young children into) .

I’d be happy to help with the Electronic Frontier Foundation submissions regarding the *take down* notices from Daniel if you’d like. Ditto for drafting a letter to the legal department of whomever sent you the *take down*. They need to know the 9th Circuit Court of Appeals’ published ruling on Sept 14, 2015, in the Lenz *take down*/*Fair Use* case and that this is BINDING legal authority on ALL federal trial courts within the 9th Circuit’s jurisdiction, which includes Idaho, Washington, Oregon, California, etc. (I put the 9th Circuit’s jurisdictional map in my earlier post today at 10:49 a.m..)

    The 9th Circuit Court of Appeals’ Lenz ruling is persuasive authority in other federal appellate courts and federal trial courts.

I know I am a very stupid and spiritually dead piece of human trash, not like Mr. Wilson and all those folks, I would have just admitted I was wrong, apologized, never married the two, sat on the victims side of the court, prayed for all involved and contacted professionals to help. Then I would have just shut up about it. But what do I know I am lost and a reprobate. I got that part of their “good news” real clear.

    Some days I just don’t post as much – I get busy with other things, or get in a funk, or don’t feel I have a lot to contribute to some topics.

    I did a few posts in older threads at the other blog, though, yesterday and today.

    I get worn out talking to the people who support gender complementarianism or patriarchy and feel the need to take breaks from them.

    If I don’t, I fear I may explode and get nasty with them, which I try not to do. It’s very hard talking to them… they are so stuck in this mindset that the Bible “clearly” teaches things like no women can be teachers, women must submit to men, etc.

    They bring up the same points again and again, ones that don’t even have biblical support but they think do (like supposedly creation order proves God wants there to be a male hierarchy etc).

    I grew up in that stuff but grew out of it and can see now where it is wrong – but some of these people are still stuck in that mindset. I find talking to them so frustrating I sometimes want to bang my head against the wall.

    Lately, I have been talking to a few of them on the other blog (including this morning on the Bayly thread) but am worn out from it.

    I don’t know where Gram3 has been – she has more patience for talking to them than I do. 🙂

    I can definitely see why the posts are upsetting on that topic. It’s really sad that so many of these people have been sold a lie, and even sadder that they try to shackle other people to their System like it was *The Gospel*. It’s not.

    You and Gram3 do a much better job of explaining the fallacies of the comp doctrine. Gram3 and her interlinear and hermeneutic points…pretty amazing what she knows/writes.

After all, DW has defended his role as pastor in their wedding. So if there was nothing wrong with what he did, i.e.: officiating at the Sitler wedding, then why threaten bloggers who have photos of that wedding?

    And for Daniel, the guy from the church demanding the *take downs* of the wedding photos he took and video images, he can be sued for infringing on bloggers’ legal rights to Fair Use of the images for discussion, comment, and criticism.

    The Ninth Circuit Court of Appeals, the federal appellate court for the Western region of the United States’ federal trial courts (which includes the state of Idaho), gave a powerful LEGALLY BINDING opinion in the Lenz *Fair Use/Take Down* case on September 14, 2015, siding with the blogger. The 9th’s ruling in Lenz applies to all similar copyright cases in the 9th Circuit’s legal jurisdiction, including Daniel’s demands for content to be removed.
